Program Description

Bank regulators have set clear expectations as to what they expect banks to cover in their written agreements with technology service providers. While many banks give much time and attention to evaluating service providers and to negotiating the business points with them, the regulators expect as much attention will be devoted to documenting the agreement between the bank and the provider. The written agreement between the bank and its service provider is the business and legal road map for governing the relationship between the parties and for allocating the business and legal risks between them. This webinar will show banks how to negotiate and draft agreements with technology service providers that meet regulatory guidance, protect the bank from unacceptable (and often unanticipated) business and legal risks, and, at the same time, meet the business needs of the bank.

About the Presenters

Kevin Funnell is a member of Bank Business Advisors, LLC, and an attorney in the Dallas-Fort Worth, Texas, "Metroplex." He has over 35 years of experience in representing business entities on transactional, business and regulatory matters, with an emphasis on financial institutions. He has advised clients on a wide variety of regulatory, corporate and transactional matters, including information acquisition, management, security and transfer, and compliance and contract issues concerning electronic commerce, personal information privacy, software, information technology, telecommunications, outsourcing and the Internet. Kevin's past experience includes in-house counsel for a large financial institution, as well as co-chair of an international law firm's Banking and Finance Practice Group.
